Welcome to RentingWaves. These Terms and Conditions ("Terms") constitute a legally binding agreement between you and Nishtha Technosoft LLP, operating the RentingWaves platform ("RentingWaves", "we", "us", or "our") governing your access to and use of our website, mobile applications, dashboards, paid plans, lead marketplace, listing tools, communication tools, payment flows, and related services (collectively, the "Platform").
Please read these Terms carefully. By accessing or using the Platform you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Platform.
Important Commercial Terms
- RentingWaves is a technology platform and property marketplace. We are not a party to property sale, rent, lease, brokerage, inspection, financing, or offline agreements between users unless expressly stated in writing.
- We may accept, reject, edit, moderate, rank, delist, suspend, restrict, or remove listings, leads, accounts, content, or access where we believe it is necessary for quality, safety, compliance, fraud prevention, or business reasons.
- Plans, prices, features, allowances, credits, lead rules, listing limits, visibility rules, boost rules, renewal terms, billing cycles, and product availability may be changed, paused, withdrawn, replaced, or discontinued by RentingWaves at any time, subject to applicable law.
- Paid fees are generally non-refundable unless a refund is required by law or expressly approved by RentingWaves in writing.
- You are responsible for verifying property, ownership, title, permissions, documents, RERA details, pricing, party identity, and transaction terms before making any decision.
1. Eligibility
You must be at least 18 years old and legally competent to enter into contracts under the Indian Contract Act, 1872. By using the Platform you represent that you meet these requirements. If you are using the Platform on behalf of a company or other legal entity, you represent that you have authority to bind that entity.
2. Account Registration
- You must provide accurate, current, and complete registration information.
- You are responsible for maintaining the confidentiality of your login credentials and for all activities under your account.
- You agree to notify us immediately at support@rentingwaves.com if you suspect unauthorised access to your account.
- We reserve the right to verify, suspend, restrict, downgrade, disable, or terminate accounts that provide false information, fail verification, create risk, misuse services, or violate these Terms.
3. User Roles
The Platform supports three primary roles:
- Buyer / Tenant: browses listings, submits inquiries, and books site visits.
- Seller / Owner: lists properties for sale or rent and manages their listings.
- Broker / Agent: intermediates between buyers and sellers through our lead marketplace.
You may hold multiple roles under a single account. Each role is subject to additional role-specific guidelines available in the Platform.
4. Listings
- All listings must be accurate, complete, and not misleading.
- You may only list properties for which you have the legal right to sell or rent.
- Listings must comply with all applicable local, state, and central laws including the Real Estate (Regulation and Development) Act, 2016 (RERA).
- Duplicate, fake, or fraudulent listings are strictly prohibited and will result in immediate account suspension.
- We reserve the right to review, reject, edit, moderate, reposition, archive, delist, or remove any listing at our discretion, with or without notice.
- RentingWaves does not guarantee any listing approval, ranking, visibility, lead volume, inquiry quality, visit, conversion, sale, rent, lease, or revenue outcome.
5. Prohibited Conduct
You agree not to:
- Post false, misleading, defamatory, or unlawful content.
- Harass, abuse, threaten, or discriminate against any user.
- Collect or harvest personal data of other users without consent.
- Use automated tools, bots, or scrapers to access or extract data from the Platform.
- Attempt to interfere with, compromise, or circumvent the security of the Platform.
- Use the Platform to advertise services unrelated to real estate without our written permission.
- Violate any applicable law or regulation.
- Bypass platform payment, lead, listing, communication, moderation, security, or access controls.
- Misrepresent ownership, authority, price, availability, location, photos, project approvals, RERA status, brokerage, commission, taxes, or charges.
6. Payments and Fees
- Certain features — including premium listing boosts, broker lead credits, and subscription packages — require payment.
- All prices are in Indian Rupees (INR). Taxes, platform fees, payment gateway charges, discounts, and other charges may be added, changed, or removed as shown during checkout.
- Payments are processed by Razorpay. By making a payment you agree to Razorpay's terms and conditions.
- Fees are non-refundable except as expressly stated in these Terms, shown in the applicable checkout flow, required by law, or approved by RentingWaves in writing.
- Payment completion is subject to successful gateway confirmation, webhook verification, fraud checks, internal review, and account eligibility.
- We may withhold activation, reverse credits, suspend benefits, or cancel access where a payment is disputed, reversed, charged back, suspected fraudulent, or incorrectly processed.
- Invoices, receipts, taxes, and payment records may be generated based on the billing details you provide. You are responsible for keeping billing and GST details accurate.
7. Plans, Credits, Leads and Platform Benefits
- RentingWaves may change, re-price, re-package, restrict, pause, discontinue, or replace any plan, subscription, boost, credit, lead package, listing allowance, feature, eligibility rule, usage limit, or promotional offer at any time.
- Plan benefits are platform permissions, not property, cash, security, investment, guaranteed business, or guaranteed lead rights.
- Unused credits, leads, boosts, featured slots, listing allowances, or subscription benefits may expire, lapse, be forfeited, or become unavailable according to the plan rules, account status, abuse controls, or operational limits.
- Lead quality, availability, exclusivity, response rate, conversion rate, phone availability, and user intent are not guaranteed.
- Promotional pricing, discounts, coupons, free trials, bonus credits, and complimentary benefits may be withdrawn, corrected, or modified at our discretion.
8. Refunds, Cancellations and Chargebacks
- Unless required by law or expressly approved by RentingWaves, all completed purchases are final and non-refundable.
- Refunds, if approved, may be processed to the original payment method and can take time depending on Razorpay, banks, card networks, or payment partners.
- We may reject refund requests arising from user error, wrong plan selection, change of mind, insufficient lead conversion, listing rejection for policy reasons, account suspension, or breach of these Terms.
- If a payment is charged back, disputed, reversed, or found suspicious, we may suspend the account, revoke benefits, adjust credits, recover amounts due, and preserve related records.
9. Platform Role and User Responsibility
RentingWaves provides tools to discover, list, compare, inquire, communicate, and manage property-related activity. We do not guarantee the existence, legality, ownership, title, condition, valuation, rental yield, price, possession, approvals, loan eligibility, tax treatment, documentation, or completion of any property transaction. Users must conduct independent verification and obtain professional legal, financial, tax, technical, or real-estate advice before acting.
10. Intellectual Property
All content on the Platform — including software, text, graphics, logos, and data — is owned by or licensed to RentingWaves and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our prior written consent.
By submitting content (listings, photos, reviews) to the Platform, you grant RentingWaves a worldwide, non-exclusive, royalty-free licence to use, display, reproduce, and distribute that content in connection with operating and improving the Platform.
11. Disclaimer of Warranties
The Platform is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the Platform will be uninterrupted, error-free, or free of viruses. We do not verify the accuracy of user-submitted content, including listing details, pricing, or ownership claims.
12. Limitation of Liability
To the maximum extent permitted by applicable law, RentingWaves and its partners, officers, directors, employees, consultants, vendors, and agents shall not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of profits, revenue, business opportunity, data, goodwill, leads, customers, property opportunity, or expected savings, arising out of or in connection with your use of the Platform. Our aggregate liability for any claim shall not exceed the lower of the amount you paid to RentingWaves for the specific service giving rise to the claim in the 3 months preceding the claim or INR 5,000.
13. Indemnification
You agree to indemnify and hold harmless RentingWaves, its affiliates, and their respective officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of your use of the Platform, your violation of these Terms, or your infringement of any third-party rights.
14. Termination and Account Restrictions
We may suspend, restrict, downgrade, disable, terminate, or refuse service to any account, listing, lead access, subscription, payment, or feature at any time where we believe there is risk, misuse, non-payment, legal exposure, policy violation, fraud, abuse, security concern, operational need, or business reason. You may close your account at any time through your account settings. Termination does not affect accrued payment obligations, audit records, legal rights, or provisions that by their nature should survive.
15. Governing Law and Dispute Resolution
These Terms are governed by and construed in accordance with the laws of India. Any dispute arising out of these Terms shall first be subject to good-faith negotiation. If unresolved within 30 days, the dispute shall be submitted to binding arbitration under the Arbitration and Conciliation Act, 1996, with the seat of arbitration in Mohali, Punjab. The language of arbitration shall be English.
16. Changes to These Terms
We may modify these Terms at any time, including to reflect changes in law, operations, products, features, plans, prices, vendors, payment methods, security requirements, or business strategy. Unless a longer notice period is required by law, changes may become effective when posted on the Platform. Your continued access to or use of the Platform after the effective date constitutes acceptance of the revised Terms.
